Triplebyte Privacy Policy

By using or accessing the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby consent that we will collect, use, and share your information in the following ways, unless you exercise your right to opt out of the sale of your information under CCPA.

Remember that your use of Triplebyte's Services is at all times subject to the Terms of Use, which incorporates this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Use.

What does this Privacy Policy cover?

This Privacy Policy covers our treatment of personally identifiable information ("Personal Information") that we gather when you are accessing or using our Services, but not to the practices of companies we don't own or control, or people that we don't manage.

We gather various types of Personal Information from our users, as explained in more detail below, and we use this Personal Information internally in connection with our Services, including to personalize, provide, and improve our services, to allow you to set up a user account and profile, to contact you and allow other users to contact you, to fulfill your requests for certain products and services, and to analyze how you use the Services. In certain cases, we may also share some Personal Information with third parties, but only as described below.

The Personal Information of Minors

As noted in the Terms of Use, we do not collect, maintain, or sell the personal information of minors under the age of 16 years without affirmative authorization. If you believe that a minor under 16 may have provided us personal information, please contact us at privacy@triplebyte.com so we can take appropriate steps in accordance with our legal obligations and this policy.

Will Triplebyte ever change this Privacy Policy?

We're constantly trying to improve our Services, so we may change this Privacy Policy from time to time as well, but we will alert you to changes by placing a notice on the Services, by sending you an email, and/or by some other means. Please note that if you've opted not to receive legal notice emails from us (or you haven't provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes.

What are my rights regarding my personal information processed by Triplebyte?

Under applicable data and privacy protection laws and our policies, you have several basic rights regarding the personal information that we process about you. Here are your specific rights:

Right to Access. The right to access the personal information we process about you.

Right to Transfer. The right to receive the personal information we process about you in a commonly used format and to have it transferred to another data controller based on your consent.

We will honor the requests you make related to your rights as the law allows, which means in some cases there may be legal or other legitimate reasons that we may not be able to address the specific request you make. You do not have to pay to exercise your rights. We will respond to your request within 30 days.

To ensure the security of your personal information, we will need to verify your identity once you make a request. To do this, we will request that you provide certain information about your identity that we can verify against our records.

If you would like to designate an authorized agent to make a request under the CCPA on your behalf, please indicate so in your email request to us at privacy@triplebyte.com or in our Privacy Center. When our users use an authorized agent to submit a request to know or a request to delete, we will generally request that: (a) you provide your authorized agent with written permission to act on your behalf; and (b) the authorized agent must verify their own identity with us. An authorized agent with a valid power of attorney will suffice for these purposes.

A name, signature, Social Security number, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information.Some personal information included in this category may overlap with other categories. C. Protected classification characteristics under California or federal law. Age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, veteran or military status, genetic information (including familial genetic information). YES Users voluntarily submit this information to us by creating a Triplebyte profile, filling in forms on our website, linking their social media profile(s) to their Triplebyte profile, or by corresponding with us by phone, email, or otherwise. This information is used to help us provide our service of connecting employers and our users and communicate with our users. Companies that use our services to be matched with job candidates. Candidate profiles created by our users are accessible to the public.
D. Commercial information. Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies. YES We collect information and track automatically products or services purchased by our users on our platform. This information is used to help us provide our service of connecting employers and our users and communicate with our users. Not shared with third parties.
E. Biometric information. Genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as, fingerprints, faceprints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data. YES Users voluntarily submit this information to us by creating a Triplebyte profile or linking their social media profile(s) to their Triplebyte profile. F. Internet or other similar network activity. Browsing history, search history, information on a consumer's interaction with a website, application, or advertisement. YES We track automatically actions people take on our platforms and the page(s) they visit and the actions people take on employers' websites that use our sourcing tools. This information helps us provide our services, such as by customizing company matches and providing customized user guidance based on their preferences. Not shared with third parties.
G. Geolocation data. Physical location or movements. YES When a person accesses our services or website, we automatically collect their Internet Protocol address. Provide our service (how does this help you provide your services) Not shared with third parties.
H. Sensory data. Audio, electronic, visual, thermal, olfactory, or similar information. YES Some users voluntarily elect to have us record their interview and/or share their photograph in their user profile. This information helps us provide our services, such as by customizing company matches. Companies that use our services to be matched with job candidates. Candidate profiles created by our users are accessible to the public.
I. Professional or employment-related information. Current or past job history or performance evaluations. YES Users voluntarily submit this information to us by creating a Triplebyte profile, filling in forms on our website, linking their social media profile(s) to their Triplebyte profile, or by corresponding with us by phone, email, or otherwise. This information is used to help us provide our service of connecting employers and our users. Companies that use our services to be matched with job candidates. Candidate profiles created by our users are accessible to the public.
J. Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99)). Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records. YES Users voluntarily submit this information to us by creating a Triplebyte profile, filling in forms on our website, or by corresponding with us by phone, email, or otherwise. This information is used to help us provide our service of connecting employers and our users. Companies that use our services to be matched with job candidates. Candidate profiles created by our users are accessible to the public.
K. Inferences drawn from other personal information. Profile reflecting a person's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. YES This information is extracted from the information our users voluntarily provide as part of our automated assessment process. This information helps us provide our services by customizing company and candidate matches. Companies that use our services to be matched with job candidates. Candidate profiles created by our users are accessible to the public.

A few things to keep in mind:

Examples listed in the chart above are illustrative of the types of personal information included in each category and may or may not be the specific types of personal information collected on an individual person. Similarly, where we indicate that we share a category of Personal Information with a third party, we do not share all of the Personal Information within that category with the third parties. It is our policy to limit the Personal Information shared within that category only on an as-needed basis in order to provide the best services to our users. Information You Provide to Us:

We receive and store any information you knowingly provide to us. For example, through the registration process and/or through your account settings, we may collect your Personal Information such as the following: address, city, current and past employers, country, date of birth, email address, first name, last name, gender, preferred pronoun, password, phone number, picture, profession, state, username, workplace and ZIP/postal code. Likewise, we will only record candidate interviews if the candidate consents.

If you provide your third-party account credentials to us, you understand some content and/or information in those accounts ("Third Party Account Information") may be transmitted into your account with us, and that Third Party Account Information transmitted to our Services is covered by this Privacy Policy; for example, we may receive some of your information from LinkedIn if you connect your LinkedIn profile with your Triplebyte account. Certain information may be required to register with us or to take advantage of some of our features.

We may communicate with you if you've provided us the means to do so. For example, if you've given us your email address, we may send you promotional email offers on behalf of other businesses or email you about your use of the Services. If you do not want to receive communications from us, please indicate your preference by opting out of receiving such emails.

Information Collected Automatically

Whenever you interact with our Services, we automatically receive and record information on our server logs from your browser or device, which may include your IP address, geolocation data, device identification, "cookie" information, the type of browser and/or device you're using to access our Services, and the page or feature you requested.

"Cookies" are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in our Services are visited and by how many people. You may be able to change the preferences on your browser or device to prevent or limit your device's acceptance of cookies, but this may prevent you from taking advantage of some of our features.

If you click on a link to a third-party website or service, such third party may also transmit cookies to you. Again, this Privacy Policy does not cover the use of cookies by any third parties, and we aren't responsible for their privacy policies and practices. Please be aware that cookies placed by third parties may continue to track your activities online even after you have left our Services, and those third parties may not honor "Do Not Track" requests you have set using your browser or device.

We may use this data to customize content for you that we think you might like, based on your usage patterns. We may also use it to improve the Services; for example, this data can tell us how often users use a particular feature of the Services, and we can use that knowledge to make the Services interesting to as many users as possible.

Will Triplebyte share any of the Personal Information it receives?

We do not rent or sell your Personal Information in personally identifiable form to anyone, except as expressly provided below. We may share your Personal Information with third parties as described below:

Potential employers: If you are a candidate looking to be matched with potential employers as part of Triplebyte's Services, we will send your Personal Information to those potential employers and their personnel (for example, their recruiting or hiring liaisons).

Information that's been de-identified:

We may de-identify your Personal Information so that you are not identified as an individual and provide that information to our partners. We may also provide aggregate usage information to our partners (or allow partners to collect that information from you), who may use such information to understand how often and in what ways people use our Services, so that they, too, can provide you with an optimal online experience.

Affiliated businesses: In certain situations, businesses or third party websites we're affiliated with may sell or provide products or services to you through or in connection with the Services (either alone or jointly with us). You can recognize when an affiliated business is associated with such a transaction or service, and we will share your Personal Information with that affiliated business only to the extent that it is related to such transaction or service. One such service may include the ability for you to automatically transmit Third Party Account Information to your Services profile or to automatically transmit information in your Services profile to your third party account; for example, you can link your LinkedIn profile with your Triplebyte account. We have no control over the policies and practices of third party websites or businesses as to privacy or anything else, so if you choose to take part in any transaction or service relating to an affiliated website or business, please review all such business' or websites' policies.

User profiles and submissions: Certain user profile information, including your name, location, and any video or image content that such user has uploaded to the Services, may be displayed to the public or to other users to facilitate user interaction within the Services or address your request for our services. Your account privacy settings allow you to limit the other users who can see the Personal Information in your user profile and/or what information in your user profile is visible to others. Please remember that any content you upload to your public user profile, along with any Personal Information or content that you voluntarily disclose online in a manner other users can view (on discussion boards, in messages and chat areas, etc.) becomes publicly available, and can be collected and used by anyone. Your name may also be displayed to other users if and when you send messages or comments or upload images or videos through the Services and other users can contact you through messages and comments.

Business transfers: We may choose to buy or sell assets, and may share and/or transfer customer information in connection with the evaluation of and entry into such transactions.Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party.

Protection of Triplebyte and others: We reserve the right to access, read, preserve, and disclose any information that we believe is necessary to comply with law or court order; enforce or apply our Terms of Use and other agreements; or protect the rights, property, or safety of Triplebyte, our employees, our users, or others.

Is Personal Information about me secure?

Your account is protected by a password for your privacy and security. You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account.

We endeavor to protect the privacy of your account and other Personal Information we hold in our records, but unfortunately, we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

What Personal Information can I access?

Through your account settings, you may access, and, in some cases, edit or delete the following information you've provided to us, such as address, city, current and past employers, country, date of birth, email address, first name, last name, gender, preferred pronoun, password, phone number, picture, profession, state, username, workplace and ZIP/postal code.

The information you can view, update, and delete through your account settings may change as the Services change. What choices do I have?

You can always opt not to disclose information to us, but keep in mind some information may be needed to register with us or to take advantage of some of our features.

You may be able to add, update, or delete information as explained above. When you update information, however, we may maintain a copy of the unrevised information in our records. You may request deletion of your account by visiting our Privacy Center or by contacting us at privacy@triplebyte.com.

Some information may remain in our records after your deletion of such information from your account. We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally.
